Assumption of Risk Form

• Sylvan Dale Guest Ranch is pleased to have the opportunity of providing you with recreational activities. Activities during your stay may include, but shall not be limited to: horseback riding, tennis, volleyball, fishing, swimming, hiking, square dancing, horse shoes, hayrides, and talent night.
• Sylvan Dale Guest Ranch personnel attempt to take every precaution to provide proper instruction in recreational activity procedures. However, all recreational activities undertaken by you may carry some risk of personal injury.
• Model Release: As a guest of Sylvan Dale Guest Ranch, you may be photographed or videotaped for promotional and/or advertising purposes. Your signature grants permission for your photographic or video images to be published without compensation.
• Under Colorado Law, an equine professional is not liable for an injury to or the death of a participant in equine activities, pursuant to §13-21-119, Colorado Revised Statutes.
• Sylvan Dale Guest Ranch reserves the right to refuse trail riding privileges to anyone who appears to be over the weight of 250 lbs., under the influence of mind-altering substances, and any person who will not adhere to the guidelines of the Ranch designed solely for our guest safety.
• Model Release: As a guest of Sylvan Dale Guest Ranch, you may be photographed or videotaped for promotional and/or advertising purposes. Your signature grants permission for your photographic or video images to be published without compensation.

By signing this agreement, Participant agrees and understands that the Ranch assumes no liability for the Participant's safety when he or she is exposed to hazardous conditions during Ranch activities, whether natural or man-made. Participant releases and agrees to hold the Ranch harmless from any liability for personal injuries (including death) or property damage sustained while on the Ranch. Cumulative of the foregoing, Participant agrees to indemnify and hold the Ranch harmless from any and all actions or causes of action, claims, demands, liabilities losses, damages, injuries, costs or expenses of whatever kind or nature, including cost of litigation, attorney's fees and reasonable expenses in connection therewith, for injury to Participant and/or for damage to or loss of the Participant's property while on the Ranch. The release and indemnification provisions of this paragraph are binding upon the Participant, his or her heirs, successors and assigns. By signing this agreement, Participant further acknowledges that they are in good physical health, are not pregnant, and have the ability to safely engage in equine activities and all other activities in which they may partake while a Sylvan Dale guest.

PERTINENT TO HORSEBACK RIDING:

Under Colorado Law, an equine professional is not liable for an injury to or the death of a participant in equine activities, pursuant to §13-21-119, Colorado Revised Statutes.

Sylvan Dale Guest Ranch reserves the right to refuse trail riding privileges to anyone who appears to be over the weight of 240 lbs., under the influence of mind-altering substances, and any person who will not adhere to the guidelines of the Ranch designed solely for our guest safety.

Riding helmets are required for youth (12 and younger) and also recommended for adults for their safety.

Please print this page, or download the PDF version, and sign showing that you are aware of the risk of injury that could result from recreational activities undertaken on the Ranch's property, while a guest of Sylvan Dale Guest Ranch. Moreover, by signing this document, you expressly agree to assume and will hold the Ranch harmless for those risks not caused by the Ranch's negligent acts of omission.
